Prenuptial agreements, also known as marital agreements, are permitted and legally recognized in Denmark. These agreements allow couples to determine in advance how their assets and financial matters will be handled in the event of a divorce or separation. In Denmark, there are no strict formalities regarding the structure or legal representation for a prenuptial agreement to be valid. However, the agreement must be in writing to be legally binding. The court will then ensure the agreement is properly recorded in the national register, making it officially recognized.
Although prenuptial agreements are enforceable in Denmark, Danish courts maintain the discretion to evaluate the fairness of the agreement. For example, if a prenuptial agreement completely excludes one spouse from any marital property or financial support after many years of marriage, the court may rule that such terms are unjust and adjust them accordingly.
