Prenuptial Agreements in Turkey

 

In Turkey, prenuptial agreements are legally permitted and commonly used to define property rights between spouses. Couples can choose from three optional marital property regimes under Turkish law:

  1. Separation of Assets – Each spouse retains ownership of their own assets acquired before and during the marriage.

  2. Participation in Acquired Assets – This is the default regime if no agreement is made; spouses share assets acquired during the marriage but keep personal property separate.

  3. Community of Property – Spouses jointly own both pre-marital and marital assets unless otherwise stated.
